Acceptance of the conditions of use
Daylogs.com supplies its services to you under the condition that you undertake to adhere to these Conditions of use that Daylogs.com shall be free to amend at any time. You are therefore advised to refer to them regularly. In addition, the use of certain Daylogs.com services may necessitate adherence to additional and specific rules or courses of action that shall be shown in a chart or regulation available on the site. These rules and courses of action shall be considered an integral part of the Conditions of use.
Description of the service
Daylogs.com is a portal for webmasters that offers free services and tools for webmasters. Daylogs.com was created and is managed by Webmaster Business, a one-person limited company with capital of 8000 Euros, the registered offices of which are at 27 rue Bargue – 75015 – PARIS, registered with the Paris Chamber of Commerce under number B438926883. Unless there is express provision to the contrary, any new feature that improves or increases one or several existing services or any new service launched by Daylogs.com shall be subject to these Conditions of use. You are aware and accept the fact that the services are supplied “as is” and that Daylogs.com cannot be held responsible for defects in your Internet connection, your IT set-up or your telephone communications. In order to use Daylogs.com, you will need access to the Internet, either directly or through systems that have access to the content supplied on the Internet, it being specified that any costs relating thereto are your sole responsibility. In addition, you must supply yourself with any equipment necessary, in particular a computer, modem or any other connection tool, in order to ensure this connection to the Internet.
Daylogs.com uses several media to stay in contact with its members. Registration on Daylogs.com implies that you agree to receive certain communications. Members may unsubscribe from these marketing communications at any time, but they may not unsubscribe from communications informing them about Daylogs.com operations. In order not to receive any more communications, they will have to unsubscribe completely from the site.
Modifications to services
You acknowledge that Daylogs.com has the right to end all or part of the access right to your account, even to delete your account, and for any reason, namely because of non-use or if Daylogs.com has good reason to believe that you have violated or contravened in letter or spirit these Conditions of use. Daylogs.com may also unilaterally and at any time interrupt the supply of its services. You accept that any termination of your account in application of these terms may intervene without prior notice. Furthermore, you accept that Daylogs.com may not be held responsible against you or against a third party for any termination of your account. Conversely, Members may terminate their accounts at any time. To do this, you must contact Webmaster Business at the address shown above.
You expressly recognise and accept that your use of Daylogs.com is done at your own risk. Daylog.com’s services are supplied to you “as is” and are accessible subject to availability. Daylogs.com does not issue any guarantee, express or implicit, with regard to the guarantees relating to the quality and compatibility of a specific usage or to the non-violation of the rules of use by its users. Daylogs.com does not guarantee that Daylogs.com shall meet your needs completely, that they will be uninterrupted, appropriate, certain or devoid of any error or that the results that may be obtained using its services will be correct and reliable.
Limitation of liability
You recognise and accept that, to the greatest extent permitted by the prevailing regulations, Daylogs.com may not be held liable for any direct or indirect damage including, in particular, losses of profits, clients, data or any other loss of immaterial assets (and this even if Daylogs.com has been informed of the potential of such damage) that may arise from the use or, on the contrary, the inability to use the site and from the cost following the purchase of goods or services in substitution, resulting from the purchase of goods or services or the receipt of messages or transactions arising at the time of use of the site.
IT and freedom
In application of statute n° 78-17 of 6 January, 1978 relating to computing, to archives and freedom, amended by statute 2004-801 of 6 August, 2004, relating to the protection of individuals with regard to the processing of data of a personal nature, the Member is advised that Daylogs.com is caused to communicate its data and information relating to it use of the site to third parties for the purposes of management of the site. In accordance with the law, the Member has a right of access and amendment over their personal data. In order to exercise it, the Member must contact Webmaster Business at the address shown above.
These Conditions of use constitute the whole of the agreement between Daylogs.com and the Daylogs.com Member in relation to the use of services, and substitutes any other agreement that may have been previously made between them and Daylogs.com. You may be subject to additional conditions of use specific to certain services, third party content and third party programmes and that is communicated to you when you agree to these services, content or software. Failure by Daylogs.com to exercise the rights accorded to them by this contract does not constitute a waiver of those rights. In the event that one or other of the provisions of these Conditions of use should be cancelled by a legal decision, the parties agree to guide the judge to bear in mind the communal intention of the parties manifest in these Conditions of use, the other provisions remaining valid and continuing to be applicable between the parties. The clause headings only have an indicative value. These Conditions of use and the relationship between Daylogs.com and the users shall be subject to French law and anything else that cannot be resolved shall be brought before the competent courts of Paris.
